A PAIR of mandarin fish – colorful reef fish known to divers for their exotic moonlit mating dances – have been spotted for the first time in Singapore.

The fish species is not known to be found naturally in the Republic, although it does occur in nearby waters, such as the Philippines, as well as Borneo and Java in Indonesia.

Yesterday fish experts said it was likely the pair had been released from the aquarium trade.

Hospital Care Coordinator Venus Tan, 49, spotted the two Mandarin Dragons (Synchiropus Splendus) at One°15 Marina on Sentosa while recreational diving around 5:30 p.m. on April 22.

On the phone yesterday, Tan said: “I hadn’t used my camera for a while, so I was hovering near some rocks on the seabed, trying to adjust the settings, when I saw a dark shape going in and out of the rubble.”

She slowly moved closer to the pile of rocks, trying not to startle the fish, and shined a faint beam from her dive torch on the rubble.

It was then that she saw flashes of the characteristic mandarin fish coloration – wavy patterns of bright blue and orange.

“My first thought was, isn’t that a mandarin fish? I got some hits quickly,” Tan said.

There were two of them, she added, although she did not see them doing their nuptial dance. The show usually takes place after sunset, when the females gather to watch the males play.

Tan’s sighting was confirmed by Zeehan Jaafar, a fish scientist at the National University of Singapore.

The sighting was published as a biodiversity record in the scientific journal Nature In Singapore. —The Straits Times/ANN

Kim Kardashian decided to recognize her ex-husband on Father’s Day and called him the “best dad of their four kids” on her Instagram story. Kim shared two stories of Kanye with their children Noth, 9, Saint, 6, Chicago, 4, and Psalm, 3. Kanye could be seen smiling and happy as he spent time with his children. The personal life of the ex-couple has been in the center of attention for the past few months. Their co-parenting struggles also make headlines with Kanye often accusing Kim of not allowing him to see his children or call his ex-wife’s parenting.

Kim captioned the story, “Thank you for being the best dad to our babies and loving them the way you do. Happy Father’s Day Ye.” In the second story, you can see the curator of the ‘Donda’ album in his compound in Wyoming surrounded by his children. The duo were also spotted at their daughter North’s basketball game and it was the first time they had been spotted together since Kim’s exotic vacation with boyfriend Pete Davidson. In the past, Ye has been seen acting erratically while seeking Kim’s attention.

Kim Kardashian Trolled on Father’s Day

Kim and Ye filed for divorce in 2021 and have maintained a one-mile distance since the rapper repeatedly attacked her 28-year-old boyfriend online. Ye accused Pete of destroying his family, threatened to beat him, and insulted him. While the beef between the rapper and comedian was engaging for fans, it certainly wasn’t healthy for either party. Now the internet has decided to troll Kim yet again for wishing Ye on Father’s Day. One user wrote, “She should stay away from our king. Respectfully.” Another user wrote, “This is the same person who didn’t even tell her the location of her daughter’s birthday party, bruh.”

One user said: “She’s not doing her any favours, ‘see her kids more’, they’re her kids too. Just days ago she was insinuating something on her show, her silly fans were already throwing words like then today this mess. She’s not fooling anyone. Another user wrote: “Tonight on Dateline, DOMESTIC ABUSE ALLEGATIONS. Next week on Today: Kim Kardashian and Father’s Day dances. It’s like a parody.”

Less than a week ago, Kim called Ye and claimed her marriage was worse than people thought. Recalling her remarks, one user said, “Right now I don’t think Ye wants her wishes after all the bullshit she said about her. @KimKardashian we won’t fall for it.” Another user said: “It’s like during WWII Hitler made the song ‘Happy Birthday President’ – Kim is the definition of a Crazy Maker.”

When does the Stuck (Up by Cardi B) emote return to Fortnite?

Emote stuck in Fortnite
epic games

Stuck is quickly becoming one of the rarest Fortnite emotes.

While most of these dance emotes have made regular appearances in the Fortnite store, one emote that hasn’t returned since its September 2021 debut is Stuck, the dance to Cardi B’s hit song Up.

Although many players have asked Epic Games to bring him back to the game, he is still nowhere to be found. In fact, it’s now been over five months since it first appeared in the store.

There’s no confirmed reason for this, but it could be that the song was only supposed to appear once in-game, or Epic could save it back for a future event. Nobody knows, but I hope he comes back soon.

While Disney World may be famous for its amazing parks, it also has a ton of jaw-dropping hotels and resorts. One of the most beloved resorts has to be Disney’s Polynesian Village Resort, one of the oldest on the entire property. Guests love the Polynesian-themed hotel and amenities, as well as the delicious restaurants and dining options it offers.

Disney’s Polynesian Village Resort has what is arguably one of the best restaurants in all of Disney World, with Ohana being a fan favorite. Another great option for guests looking for dinner and a show was the Spirit of Aloha experience. However, it has been announced that it will be closing permanently as the entire complex continues to undergo renovations and construction.

Disney World describes the show as follows:

Hula dancing, fire dancing and more

Celebrate the spirit of aloha with spellbinding dancers, drummers and a breathtaking fire knife performer.

Aunty Wini is hosting a fun luau to say goodbye to one of the local girls heading to the “mainland” for college – and you’re invited!

In the outdoor theater at Luau Cove, revel in the exciting traditions of Polynesia, including dances from Tahiti, Samoa, Tonga, New Zealand and Hawaii.

An all-you-can-eat tropical feast

Sit down to plates of authentic Aloha pulled pork, Polynesian ribs, roast chicken and seasonal vegetables. Savor fresh-cut fruit and a salad with ginger-lime vinaigrette, then finish your meal by indulging in pineapple guava cake and chocolate cake!

Kid favorites like Chicken Breast Nuggets with Tater Bites, Cheese Pizza and Grilled Chicken or Fish of the Day with Rice and Green Beans are also available on request from the limited kids menu.

In addition to soft drinks, lemonade, coffee, and other non-alcoholic beverages, guests 21 and older can enjoy beer and wine with their meals. For an extra, treat yourself to a fruity cocktail, like the Pau Hana Punch served in a hand-carved coconut souvenir.

Now we can see that Disney has started tearing down what was once the SPirit of Aloha dinner experience in a tweet shared by Brayden (@SirBrayden):

In September 2020, The Walt Disney Company laid off thousands of Cast Members, including iconic Spirit of Aloha performers at Disney’s Polynesian Village Resort. It was the first sign that things might not be going so well for the dinner show.

Celebrate the spirit of the South Pacific in this oasis of tropical palms, lush vegetation and more. From moonlit nights immersed in outdoor island ambience to the exotic flavors of our world-class restaurants, experience the signature tropical atmosphere that has made Disney’s Polynesian Village Resort a favorite Disney destination since 1971.

Choose from a wide range of accommodations, from rooms and suites – some offering concierge service – to home-like options in the villa section of the resort. All room types share the same resort amenities, including pools, restaurants, and recreation.

Make a new friend at the movies

There are two types of people: those who prefer reserved seat in movie theaterand those who appreciate old fashioned way choose your seat when you arrive at the theatre.

These two seat styles come with risks. If you arrive too late for a popular new movie with free seats, you might be stuck with a front row seat. However, if you book a seat in an empty theater, a stranger might reserve a seat right next to you. And then it’s just you two, awkwardly watching a movie together in an empty alley. This last situation has become a meme.

About to make a new friend“, writer Natalie Marlin tweeted this week, with a screenshot of an empty projection by David Cronenberg Future Crimes and the selection on a sit next to the only reserved seat at the theatre. He received more than 400 tweet quotes and 100,000 likes.

“A lot of people assume that I’m actually [picked] this seat for real instead of just picking this up for a joke and sitting away from this person come on now,” she wrote in a follow-up tweet. The Twitter account of Variance Movies posted a similar joke. And another person posted a combination Wordle and “about to make a new friend at the cinema” same.

In February, a claimed TikToker a seeing person Spider-Man: No Coming Home “need[ed] a friend” and chose the seat right next to them. The video invited people’s outrage who said the situation would make them uncomfortable and force them to move.

In case you think no one actually does, Twitter and Reddit is full of stories of people who pretend someone sat next to them in a empty theater.

It seems that most people prefer have space between others in an empty theater. But this meme offers a warning: if you’re the first person to book a seat in an empty theater, you might unwittingly acquiring a movie buff friend.

The protection of traditional knowledge requires serious action https://nkfan.net/the-protection-of-traditional-knowledge-requires-serious-action/ Mon, 06 Jun 2022 06:02:25 +0000 https://nkfan.net/the-protection-of-traditional-knowledge-requires-serious-action/ OWhat’s so enchanting and challenging about the concept of traditional knowledge (TK)? OWhat’s so enchanting and challenging about the concept of traditional knowledge (TK)? Several decades have passed after the infamous enigma created by the alleged patenting of three Indian household products, namely haldi, neem and basmati. The subject of TK continues to be a much sought-after area of research, but no specific TK law has yet been developed. Why is this so? The universally recognized meaning of traditional knowledge is that it refers to all forms of knowledge systems that originate in a given community, primarily indigenous groups embodying their tradition, culture, beliefs, skills and practices that are passed down from generation to generation by their ancestors. Therefore, TK covers anything that derives from tradition, hence aptly called traditional or tradition-based knowledge.

India is known as a land rich in traditional knowledge, but the irony is that there is no special law or policy framework to address issues of preservation, commercial misappropriation and sustainable use. traditional knowledge. In the absence of a national law on traditional knowledge, it is preferable that the State concerned enacts its own national laws to preserve and protect its valuable traditional knowledge. In a way, this approach will be quite doable. The Indian State has the responsibility to preserve and protect its unique and valuable TK as the custodian of TK while clearly recognizing the ownership of TK in the local or indigenous community to which it belongs. In the contexts of North East India, a region of exotic tribes and cultures with rich TK possessed by large ethnic groups, state-framed TK law and policy will be the best option. . It is pertinent to mention that each tribe in the North East has its own customary laws and community rules governing TCEs, as the cultural identity of the tribes is considered paramount and additional measures are taken by the indigenous tribes to protect their ethnic identity within a traditional framework. customary regime and self-created community norms. Such a customary regime must be duly recognized by the legal regime for traditional knowledge. This is also the mandate of the United Nations Declaration on the Rights of Indigenous Peoples, 2007 voted by India. Customary laws are not a uniform code, they vary from state to state and within a state as well. Any legal framework based on traditional knowledge must take into account the diversity in the customary context and leave the primary burden to each community. If an indigenous community has already adopted traditional protocols related to TK, it should be supported and those that do not should be facilitated. The TK-specific law must fill in the existing gaps in current intellectual property laws, for example the copyright law’s silence on folklore, patents only offer defensive protection, the law on biodiversity is more focused on biological and genetic resources, access and benefit-sharing guidelines (post-Nagoya era) is also not exclusive to traditional knowledge. The moot point is all intellectual property laws as they exist. Traditional knowledge is only granted secondary status as a passing reference. The best possible way to build is to strengthen community control, management and administration over TK. The State should provide adequate legal awareness and training on the intellectual property value of traditional knowledge and its commercial prospects.

Some of the countries with large populations of indigenous people who are pioneers in sui generis regime on traditional knowledge are, African Regional Industrial Property Organization-Swakopmund Protocol on the Protection of Traditional Knowledge and Expressions of Folklore; China – Regulations on the Protection of Traditional Chinese Medicines and Regulations on the Protection of Traditional Arts and Crafts, 1997; Kenya-Traditional Knowledge and Cultural Expressions Protection Act, 2016; Panama-Special Intellectual Property Regime Governing the Collective Rights of Indigenous Peoples for the Protection and Defense of their Cultural Identity and Traditional Knowledge; South Africa-Protection, Promotion, Development and Management of Indigenous Knowledge, 2019; Vanuatu-Traditional Knowledge and Cultural Expressions Protection Act 2016; Zambia – Protection of Traditional Knowledge, Genetic Resources and Expressions of Folklore Act 2016 and some others.

India has always been a strong advocate for TK protection in all relevant international fora and acclaimed for establishing TKDL as a good model and pioneering initiative in documenting Indian traditional medicinal knowledge systems. Regrettably, legislators have ignored the issue of the need for a special law on traditional knowledge, even though important amendments have been made to national intellectual property laws, but traditional knowledge has not been subject to no serious consideration on the part of decision makers. The effort on TK legislation should ideally have started with the creation of the TKDL by the central government. It is believed that the State should replicate the model of TKDL and help the community to preserve the TK and TCEs that belong to them. This will help them convert their oral TK into tangible form and establish any prior art or proof of origin claims. The fact that many GI applications from Northeastern states are rejected due to the lack of documentary historical evidence of the geographical origin of the product. Most of the Northeast region has an oral history passed down from ancestors without much written record, and the prevailing intellectual property regime relies primarily on prior art in writing. This gap can be filled by initiatives like TKDL at the local level. Several tribal communities maintain their own traditional heritage museum as a community initiative to preserve their culture and traditions, arts, crafts, folklore and dances as a library of typical traditional knowledge. All it needs is a balanced policy base on IPRs and new economic strategies related to TK. Considering that traditional knowledge is one of the countless by-products produced by industry. Whether in cosmetics, pharmaceuticals, textiles and fashion, food, agriculture, horticulture, etc., traditional knowledge makes a significant contribution. Due to the lack of a clear law, free riding continues.

In the age of the Internet and social media and overwhelming platforms like Facebook, YouTube and vlogs, it is very easy for anyone to upload or post material containing TK and TCEs by anyone there. has accessed. The question is how to regulate the use of traditional knowledge on digital platforms and social media? In the absence of law, it is difficult. It is observed that many videos made on the traditional cultural heritage of the northeast by travel bloggers are licensed without the permission of the community that owns them and may contain very sacred or secret traditional knowledge of the peoples. indigenous. It is far too complicated for innocent tribes to realize the loss of cultural assets in the age of technology. They self-publish a lot of audiovisual content relating to TK and TCEs, ignoring its economic ramifications and intellectual property implications. Today you tube has become a good source of income for many. This highlights the essence of prior informed consent and benefit sharing for the commercial use of traditional knowledge on the Internet and other digital media. Traditional community laws and protocols must be respected in digital use. But where are the law and the watchdog to monitor such abuses? The community happily shares traditional knowledge with the tourist without worrying about possible dangers. They mainly see it as a cultural exhibition to the world and are proud of it. The unregulated circulation of traditional knowledge in the public makes it vulnerable to commercial exploitation. Terms of use should be defined at the time of access to TK so that control of TK remains in the hands of the owners.

Ten years ago, Air India painted “Tsungkotepsu”, the traditional Ao Naga shawl on the tail of its plane. A delight of red and black stripes and hand-painted patterns on the central band, woven by the women of the Ao Naga tribe of Nagaland. It appears that no permission was taken from the Ao community or that Air India declared in any form that the shawl design represents the Ao tribe, a benefit sharing never thought of by anyone. The traditional Ao shawl is a weaving of folk art and culture held with immense pride. Many authors have reported rampant cases of “cultural plagiarism” of various traditional Naga shawls by popular online shopping sites and designers selling cheap imitations without permission. It is worth mentioning here the controversy over the “Cowichan sweater”, a traditional hand-knitted Aboriginal sweater from the Cowichan Nation, a Coast Salish nation located in what is now known as Duncan, British Columbia. . Hudson’s Bay Company was the commercial partner for the Vancouver 2010 Olympic Winter Games. They got a mass-produced Cowichan-style sweater in China, an imitation of the native Cowichan sweater. HSBC and the Olympic Committee have been widely criticized for altering the aesthetics of the Cowichan sweater, as well as for economic losses to those who created the original garments, as several Cowichan families were financially dependent on the knitting of the Cowichan sweater. These experiences are revealing in themselves. At least in the case where traditional medicinal knowledge is patentable, we have some recourse under patent law. But when it comes to cultural appropriation of this nature, there is no legal recourse, paving the way for a free-for-all situation. It is time to act seriously and responsibly to secure traditional knowledge before all is lost.

Strippers turn to unions after litigation, legislation falters https://nkfan.net/strippers-turn-to-unions-after-litigation-legislation-falters/ Tue, 31 May 2022 14:59:43 +0000 https://nkfan.net/strippers-turn-to-unions-after-litigation-legislation-falters/ “Selena the Stripper” danced in Los Angeles-area clubs for about five years, which included a period marked by steep pay cuts from fewer patrons during the pandemic, in addition to stage fees eating into the wages. “Selena the Stripper” danced in Los Angeles-area clubs for about five years, which included a period marked by steep pay cuts from fewer patrons during the pandemic, in addition to stage fees eating into the wages.

Unmet lap dancing quotas have often left some exotic dancers in the red, and many say they’re forced to lose weight or even face racial discrimination in the form of less desirable changes. Increasingly complex labor contracts, thanks to new enforcement rules in California, could mean fewer hours for some.

Dancers also fear they have little recourse if they are hurt or harassed.

Selena, who asked to use a stage name to avoid retaliation, is among the dancers leading an effort to unionize strip clubs across the state in a bid to improve wages and working conditions.

“These clubs and big franchises don’t like the idea of workers taking over. It sets an example and shows what is possible,” said Selena, president of independent union Strippers United. “Strippers are treated like they have no value and they have internalized that. They don’t always see themselves as deserving of rights.

California’s labor push comes amid a mountain of litigation over wage and hour practices, harassment and misclassifications that has led to multimillion-dollar settlements against clubs across the country. Several courts have ruled that strippers are legally employees under wage and hour laws, rather than independent contractors.

A California worker classification test, codified in 2019 as Assembly Bill 5, has made it harder for companies to defend business models that rely on independent contractors.

But strip club operators, dancers and lawyers told Bloomberg Law that neither the measure nor the litigation had caused sweeping changes in the industry.

Now some say unionizing is the best way to help dancers.

“The Legislature cannot solve this problem because it solves things with such a broad brush and the problems of this industry are so narrow to this industry,” said Kevin M. Osborne, partner at Erickson Kramer Osborne LLP. , a class action boutique. law firm in San Francisco. “The union could bargain in its best interests without being subject to these general labor laws, but does not necessarily provide workers with what they need.”

Picketing for Rights

Strippers United, an independent union formed in 2018, first targeted the Star Garden Topless Dive Bar in Los Angeles, where dancers have been picketing for weeks to pressure owners to recognize the union.

Star Garden is said to be the first unionized strip club in the United States since 1996, when strippers formed the Exotic Dancers Union at the Lusty Lady Peepshow in San Francisco. Lusty Lady, whose dancers organized under the Service Employees International Union, closed in 2013.

Star Garden did not respond to multiple requests for comment. The club’s labor lawyer also did not respond to a request for comment.

A few dozen dancers have sent a petition to club owners demanding better safety conditions and the reinstatement of workers who allege unfair retaliation. They also filed unfair labor practice charges with the National Labor Relations Board and safety reports with the California Division of Occupational Safety and Health regarding bed bugs, broken glass and protruding rusty nails on stage.

Lilith, who also asked to use her stage name to avoid retaliation, has been on the Star Garden picket line every week since March. She says she has to sign a “lease agreement” that makes her an entrepreneur and prevents her from earning an hourly wage. Instead, she receives tips and splits payment for lap dances with clubs.

She said she could make as little as $100 per shift to over $1,000 per night.

Lilith loves to get naked but has sometimes felt unsafe. She played with broken glass in the lap dance area and then pulled a shard off her heel and experienced another dancer who cut her foot.
Another time a drunk customer came to pick her up and she couldn’t get him off.

But it was the firing of two colleagues who complained about safety issues and unruly customers that sparked the petition and the picketing, Lilith said.

“We’ve all had our own individual experiences, where customers crossed our borders and security didn’t intervene and we had to fend for ourselves,” she said. “It’s really those things that turned us on.”

Closing Clubs

Ryan Carlson, CEO of Deja Vu Services Inc., one of the largest strip club operators in the United States, said seven of its clubs in California became unprofitable and were forced to close after were forced to classify dancers as employees. Dancers at the remaining clubs only get part-time shifts, he said.

Deja Vu clubs are also losing dancers to competitors who haven’t changed the way they classify workers, he said.

“Professional artists want to go home with money and set their own schedules,” Carlson said. “The employment model cannot offer this because a club cannot operate with massive overtime, unpredictable schedules and a host of other practical impossibilities that arise.”

Carlson also dismissed the union effort, pointing to a previous unsuccessful campaign in San Francisco. Artists value independence and autonomy, he said.

“Plus, an average dancer under the job model still earns over $50 an hour, which is more than most educated professionals,” he said. “It will be interesting to see how quickly a union of dancers can drive a club out of business.”

Obstacles remain

Class action lawsuits have produced major court victories and settlements in California and elsewhere, including Ohio, New York, Florida and Nevada. California’s commissioner of labor is also investigating, according to documents obtained by Bloomberg Law, a series of complaints alleging that clubs in the state failed to pay wages and made illegal tip deductions between 2019 and 2022.

But large-scale wage and hour, harassment and misclassification cases filed by strippers plateaued in 2019, said Manny Starr, an attorney at the Frontier Law Center who has represented dancers. It would be unusual at this stage for there to be another lawsuit against a major operator, and cases involving smaller clubs are harder to come by, he said.

“I believe these individual cases exist, and they’re probably having their rights violated, but that doesn’t get the attention of the larger types of class action lawsuits,” Starr said of companies on the plaintiffs’ side that would traditionally take on such cases.

Brad Nakase, a California-based attorney who has represented dancers, said he receives a dozen emails a week about “unfathomable mistreatment and employment law violations”.

But few lawyers are willing to step in because of concerns for personal safety, small damages or insufficient numbers of dancers for a class action, he said.

Strippers United’s Selena, who frequently speaks to strippers in the state, said the AB 5 likely made things worse. Dancers are required to sign restrictive contracts that see them as partial club owners, or they are given so few hours as employees that they cannot earn enough money from their shifts.

“You have to work double hard, and many are not making a quota with the pandemic. And after the pandemic, the wages went down and the money wasn’t what it used to be,” Selena said. “The dancers are really hurting and struggling under the burden.”
